PRIVATE COPYING: THE ITALIAN COUNCIL OF STATE CONFIRMS THE LEGITIMACY.
The Italian Council of State (a legal-administrative consultative body and ensures the legality of publici administration in Italy) reaffirms the legitimacy of the private copying’s rates in force in our country, confirming the case law already expressed by the TAR of Lazio with the judgments delivered in 2012.
One should still clarify the issue concerning devices for professional use: the Council of State has asked the European Court of Justice a legal advice about the current compensations’ pay back system adopted by SIAE.
